Terms and Conditions

Introduction

Welcome to FitcationHQ (“FitcationHQ”, “we”, “us” or “our”), operated by GW TRAVEL LIMITED, a company registered in New Zealand. FitcationHQ is a travel content and trip-planning website. We publish travel articles and guides, offer a paid custom itinerary-planning service, and provide a trip-builder tool made up of a web dashboard and a companion browser extension that uses AI to help you turn saved places into a draft itinerary.

These terms and conditions govern your use of our website, our trip-builder tool and browser extension, and our itinerary-planning service (together, the “Services”), and form a legally binding agreement between you and us. By using any of the Services you agree to be bound by these terms. If you do not agree, please do not use the Services.

We may update these terms from time to time. The current version is always posted on our website and applies from the date it is posted. Where changes are material, we will take reasonable steps to let you know. It is your responsibility to review these terms periodically.

These terms should be read together with our Privacy Policy and our Refund and Cancellation Policy.

Nothing here limits your Consumer Guarantees Act rights

If you are a consumer in New Zealand, you have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 that cannot be excluded. Nothing in these terms is intended to limit or exclude those rights. Where you acquire our Services for the purposes of a business, you agree that the Consumer Guarantees Act does not apply.

What we do (and what we no longer do)

FitcationHQ previously operated as a travel agency selling and running travel packages. That part of the business has been sold and we no longer sell or operate travel packages. Today our Services are:

  • Travel content — articles, guides, destination information, and recommendations published on our website for general information only.
  • Custom itinerary-planning service — a paid service in which our planners prepare a personalised itinerary or recommendations based on the information you give us. Details and pricing are on our Travel Planning page.
  • Trip-builder tool and browser extension — a tool that lets you save places from the web, organise them into trips, and generate a draft itinerary, including AI-assisted “advanced” generation paid for with credits.
  • Optional booking assistance — where expressly agreed as part of a planning engagement, we may help arrange certain bookings (such as accommodation, tours, transfers or flights) with third-party suppliers on your behalf. We do this only when agreed in writing for that engagement.

Our role for any optional booking

Where we assist with a booking, we act only as a booking agent between you and the relevant supplier (airline, hotel, tour operator, transfer company, etc.). The travel product or service itself is supplied by that third party under their terms and conditions, which may include their own pricing, availability, cancellation, change and refund rules. We are not the supplier and are not responsible for the quality, safety, suitability, accuracy, delivery, or availability of any third-party travel product or service. You are responsible for reviewing and complying with each supplier’s terms before a booking is confirmed, and for dealing directly with the supplier about any issue with what they supply. We will tell you before confirming any booking whether it is non-refundable or only partially refundable.

Information, recommendations and AI-generated content are not guarantees

Our content, planner recommendations, and AI-generated itineraries are provided to help you plan. They are suggestions, not guarantees.

  • Verify before you rely. Travel details change. You must independently verify time-sensitive or safety-critical information — including opening hours, prices, availability, routes, transport, entry requirements, permits, and the difficulty, fitness and safety requirements of any activity — before you act on it.
  • AI-assisted generation. “Advanced” itinerary generation uses third-party AI models to synthesise your saved places into a draft plan, and may add “free-time” suggestions drawn from mapping data. AI output can contain errors, omissions or out-of-date information, and place suggestions may occasionally be inaccurate. Treat every AI-generated itinerary as a starting draft to check, not a booked plan.
  • Your responsibility to travel safely. You are responsible for assessing whether any suggested activity is suitable for your fitness, experience and the conditions on the day, and for arranging appropriate travel insurance, documentation, vaccinations and permits. We strongly recommend comprehensive travel insurance.

Accounts

Some Services require an account. You agree to provide accurate, current and complete information, to keep it up to date, and to keep your login credentials secure. You are responsible for activity that occurs under your account. Tell us promptly at admin@fitcationhq.com if you suspect any unauthorised use. You must be at least 18 years old, or have the consent of a parent or guardian, to create an account or buy credits.

Credits and the trip-builder tool

Advanced (AI) itinerary generation is paid for using credits.

  • Credits are sold in packs through our website (currently 5 credits for US$5; the price shown at checkout applies). One credit allows one advanced generation.
  • Credits have no cash value, are not a stored-value or payment instrument, and cannot be transferred, sold or exchanged.
  • Credits are consumed when you run an advanced generation. If a generation fails on our side, the credit used is automatically returned to your balance.
  • Creating and storing trips and places, viewing your data, and “basic” (non-AI) generation are free within the limits shown in the tool. Running out of credits never deletes your saved data — it only pauses advanced generation until you top up.
  • Credits are non-refundable once purchased, except where you have rights under the Consumer Guarantees Act 1993 or other law that cannot be excluded. See our Refund and Cancellation Policy for full details.

We may set and adjust reasonable usage limits (such as the number of trips, saved places, or pack size). We will not reduce credits you have already purchased.

Payments

Payments for credits and for the itinerary-planning service are processed by third-party payment providers (such as Stripe via WooCommerce, and PayPal where offered). By paying, you authorise the charge and agree to the payment provider’s terms. We do not store your full card details. You agree to pay all fees and applicable taxes for the Services you purchase. Prices may change, but changes do not affect credits or services you have already paid for.

The browser extension

The FitcationHQ trip-builder extension lets you highlight a place name on a web page and add it to your trip.

  • The extension captures only the text you explicitly highlight and choose to add, together with the URL of the page you add it from. It does not read, track or transmit your general browsing activity or the content of pages you do not act on.
  • The extension communicates only with FitcationHQ’s own service to save your places and run generations. It uses minimal browser permissions for this purpose.
  • You must use the extension only with content you are entitled to access, and in line with the terms of the websites you visit.
  • The extension is also subject to the rules of the browser web store it is distributed through.

Acceptable use

When using the Services, you agree not to:

  • use the Services for any unlawful, fraudulent or harmful purpose, or in breach of any third party’s rights;
  • copy, scrape, resell, or commercially exploit our content, itineraries, or tool output except as expressly permitted;
  • attempt to bypass credit, usage or access limits, or to gain unauthorised access to our systems, accounts or data;
  • interfere with, overload, or disrupt the Services or attempt to reverse-engineer them except to the extent the law allows;
  • upload or submit content that is unlawful, infringing, misleading, or that you do not have the right to submit; or
  • misuse the extension to capture or process data you are not entitled to.

We may suspend or terminate access to the Services for any breach of these terms, or where reasonably necessary to protect the Services or other users.

Intellectual property

All content we publish — articles, guides, images, branding, the tool, and the software — is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable licence to use the Services and to use itineraries we generate or prepare for you for your own personal, non-commercial travel planning. You may not reproduce, distribute, or commercially exploit our content or tool output without our written permission.

You retain ownership of the content you submit (such as saved places, notes and trip details). You grant us a licence to host, process and use that content to provide and improve the Services, including by sending it to the third-party AI and mapping providers needed to generate your itinerary, as described in our Privacy Policy.

Third-party links and services

Our website and itineraries may link to third-party websites and services that we do not control. We are not responsible for their content, products, or privacy practices, and inclusion of a link is not an endorsement. Your dealings with any third party are between you and that third party.

Limitation of liability

To the fullest extent permitted by law, and subject to the “Consumer Guarantees Act rights” section above:

  • the Services and all content, recommendations and AI-generated itineraries are provided on an “as is” and “as available” basis;
  • we are not liable for any indirect, incidental, consequential or special loss, or for loss of profit, data, or opportunity, arising from your use of the Services; and
  • we are not liable for loss arising from your reliance on information, recommendations or itineraries without independent verification, from the acts or omissions of third-party suppliers, or from events beyond our reasonable control.

Where our liability cannot be excluded but can be limited, and to the maximum extent the law allows, our total liability to you for any claim connected with the Services will not exceed the amount you paid us for the specific Service that gave rise to the claim in the 12 months before the claim.

Indemnity

You agree to indemnify us against any claims, losses, liabilities and reasonable costs arising from your breach of these terms, your misuse of the Services, your breach of any law, or your infringement of any third party’s rights, except to the extent the loss is caused by us.

Complaints and disputes

If you have a concern, please contact us first at admin@fitcationhq.com so we can try to resolve it. We will acknowledge your complaint promptly and work with you in good faith to reach a fair resolution. If we cannot resolve it, you may pursue any rights or remedies available to you under New Zealand law, including through the Disputes Tribunal or other appropriate forum.

Governing law

These terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. Nothing in this clause limits any non-excludable rights you have under New Zealand consumer law.
